This case involved a 63-year-old Englishman who has called Australia home for the past 35 years. When he approached IR Legal, he was serving a five-year prison sentence and facing mandatory cancellation of his Residence Visa due to his criminal record.
Our Principal Lawyer, Ismail Rasheed, represented him at a rigorous two-day hearing involving detailed examination and cross-examination of witnesses, including a forensic psychology expert. The matter concluded with a reserved judgment. Following the hearing, our client messaged his daughter saying, “Ismail was brilliant… I couldn’t have had a better counsel.”
Ismail’s closing submission was both brilliant and thought-provoking. He argued that when an individual has lived in Australia for many years, with deep roots and strong community ties, it should require compelling evidence to justify removing them from the country they call home.
In a memorable moment, Ismail remarked that after 35 years, the client’s only remaining connection to the United Kingdom was his unshakeable British accent — a comment that lightened the room with humour and hope, even drawing laughter from the Tribunal Member and opposing counsel.
